Sayek Miah, 24, told the court he ‘wanted to try his luck’ with the drunk 23-year-old in the back of his dad’s Honda after his friend Andy Udenze, 23, had bragged of having sex with her.
Miah said the student was accidentally locked in the car in Grange Walk, Bermondsey, while he and his four co-accused smoked cigarettes on the street.
‘She was resting, but when I opened the door she woke up.
I smiled at her and she smiled back,’ he claimed.
‘I thought: ”I’ll have a go.
I’ll try my luck.
I opened the back door and I climbed in.
‘She said ‘hi’ to me.
There was a bit of touching involved.
‘
Miah claimed the girl fondled him and he got into a sexual position.
His defence council Mr David Aaronberg asked: ‘Were you intending to have sex with her?
‘If she was complying, yes,’ Miah replied.
But he added: ‘She wasn’t very thrilled.
She wasn’t very active.
I didn’t think she was very willing so I left it at that.
‘
‘She wasn’t exactly ripping off her clothes or anything like that,’ Miah went on.
He claimed he got out of the car and told the other four: ‘She’s not up for it.
‘
The court has heard Miah was seen to push the student’s legs apart.
A member of the jury sent a note which read: ‘Why would you try to open her legs before you sought her consent?
Miah replied: ‘At the time the girl had given me physical consent.
‘Unfortunately I never did ask her, not as a direct question.
‘
And Miah denied there had ever been a plan
to gang rape the girl, who was clearly in ‘no fit state to have sex with anyone.
‘
‘I didn’t talk about this no,’ he said
