Clubber who asked cop for sex is spared jail
An entrepreneur who exposed himself to a police officer after being thrown out of a private members club was spared jail and banned from Soho.
Police were called to the exclusive Blacks Gentlemen’s Club in London’s West End after staff caught Mattijah Sedlak, 29, pleasuring himself in the kitchen without his trousers on.
Sedlak, who helped launch ecoLife, an environmental consultancy to businesses and individuals, had spent the evening of June 11 on a pub crawl and was very drunk.
Staff persuaded Sedlak to dress himself and the entrepreneur then headed out on to the street.
He was approached by two police officers on Bourchier Street, but became distressed when he realised he had forgotten his bag in the club’s kitchen.
While one officer left to retrieve his bag, the second waited with Sedlak who was slumped in a bus stop.
Prosecutor Lestyn Morgan said Sedlak started talking to one of the constables, asking if he was ‘interested’ in him.
‘The officer said the conversation was inappropriate and told him to behave himself.
‘He looked away, he heard Me Sedlak talking then felt him touch his penis over his clothes.
‘He looked around and he saw that Mr Sedlak was masturbating with his penis totally exposed.’
Sedlak was arrested and charged with sexual assault and indecent exposure, but he claimed his drink must have been spiked.
The arresting officer, who claimed he was sexually assaulted, said: ‘He appeared drunk, the smell of alcohol was overpowering – we brought Mr Sedlak to one side and we asked him where he had come from.
‘My colleague went to pick up his bag and I stayed with him. He started saying some inappropriate things.
‘It was the first night shift I had done in Soho and I wanted my colleague to return because I was feeling very uncomfortable.
‘When he started saying the sexual stuff I just tried to ignore him as much as possible, and the next thing I felt was his hand touch my private area.
‘He was quiet for a few minutes. I was getting nervous because I had just joined a new team and I didn’t know any of my colleagues’ radio numbers.
‘After a few minutes he stared whispering again very softly and I realised he was masturbating again, I told him to put it back again – it’s hard to arrest someone when you are alone.
‘There was a lot of drama. It was attracting a lot of people and a lot of people came from Old Compton Street to look,’ he said.
Police officers were forced to cuff Sedlak in the rear stacked position because he became so aggressive.
He tried to cling on to a tree and had to be dragged to the police van and proceeded to kick and shout all the way to the police station.
It took them an hour to book him into the police station rather than the usual 20 minutes because he was being so difficult.
Sedlak was acquitted of sexual assault by a jury at Southwark Crown Court but convicted of indecent exposure.
He moved to the UK from Poland five years ago having trained as a paramedic in his home country.
Sedlak initially worked as a career for disabled adults and as a horse trainer before helping launch ecoLife.
Brian Russell, defending, said: ‘I would submit the report shows he is pretty horrified with what he did.
‘He is not going to go out drinking alone in Soho, certainly not in the near future.’
Sedlak was given a 12-month community order with a three-month electronic curfew between 9pm and 6am.
Judge Stephen Robbins also imposed a six-month exclusion requirement from the Soho area and said: ‘The fact is you have no previous convictions. This behaviour was out of character.
‘You do undoubtedly show remorse and are apologetic. How much insight you show is another matter.’
Sedlak, of St Mary’s Road, Tonbridge, Kent, was acquitted of sexual assault, but convicted of exposure.
He must also pay £1,400 prosecution costs.
