BMW driver faces jail mowing down cyclist

A BMW driver who left a cyclist for dead with brain injuries after he knocked him off his bike on the wrong side of the road is facing jail.

CCTV footage caught Sean Fagan, 29, hitting 22-year-old medical student Josh Dey on Easter Sunday in Swain’s Lane, Highgate and driving off.

He admitted causing injury by dangerous driving and failing to stop after a road traffic accident at Blackfriars Crown Court.

Arizuna Asante, prosecuting, said Mr Dey had suffered several injuries.

Mr Asante said: ‘He suffered a bleed on the brain which we will need to know more about.’

Ciara McElvogue, representing Fagan, said: ‘This case was sent from Highbury Corner Magistrates Court. The defendant instructs me that he was unrepresented.

‘He was told by the court that he would not lose credit if he pleaded at this court but he is very anxious.

‘He was unrepresented at the police station and he reassures me that he panicked and didn’t know what to do and so said no comment.’

Judge John Hillen adjourned the sentence to allow for medical and probation reports.

‘There was a catastrophic brain injury and some injuries to the right leg but the brain injury is the most serious incident,’ Judge Hillen said.

‘You have pleaded guilty and I am told you had wished to plead guilty at the Magistrates Court.

‘If that is accepted by the sentencing judge then full credit will be given.

‘This is a serious matter which would normally attract an immediate prison sentence.

‘I am going to adjourn for a pre-sentence report to be written, we need to know more about you.

‘The harm which was caused to the victim is also a matter which will need to be taken into account.’

Fagan, of Regina Road, Islington, admitted one count of causing injury by dangerous driving, failing to stop after a road traffic accident and failing to report an accident to the police.

He was bailed ahead of sentence on July 2.
