‘Sorry I groped that woman’s bottom – I’ve got Asperger’s you see’

A traffic marshall who groped a woman on the Tube has been spared jail after he blamed his offending on Asperger’s Syndrome.

Daniel Omozusi, 39, approached a woman just outside Oxford Circus underground station and grabbed her buttock Monday, 26 November 2018,

The victim, aged 35, turned around and challenged him but he denied touching her and tried to run off.

But the victim took pictures of him which allowed police to track him down.

He was arrested by officers on Wednesday, 2 January and admitted the offence.

In impact statement read out to the court the victim said: ‘I no longer feel safe.

‘I have felt anxiety about this.

‘The incident made me feel very much in shock.

‘When I went to my office I had a cry..

A pre-sentence report recommended rehabilitation rather than an immediate custodial sentence.

Brereton Horne, defending, said that his client works as a traffic marshall and pays his own rent.

‘He has his own address, but he spends a lot of time at his mother’s address.’

Judge Nicholas Loraine-Smith told the defendant that this offence had affected the victim.

‘This was an offence that really troubled the victim, although it is accepted that you touched her very briefly.

‘She was very upset by it.

‘I do accept that in your case because of your Aspergers it is a very complicated situation.

‘This has to be marked by a custodial sentence of three months in prison.’

However the judge suspended the jail term for two years.

Omozusi of Hackney, East London admitted sexual assault.

He was given three months in jail suspended for two years and was ordered to do 45 day rehabilitation activity requirement.
