Three kebab shop workers accused of kicking two customers a ‘good kicking’ walked free from court today (THUR).

Huseyin Aslan, 43, his son Ergun Aslan, 24, and 22-year-old waiter Kemal Koca allegedly dragged the tube workers from their shop and beat them up.

Stephen Hayes, 40, was left with a broken jaw and Robert Page, 46, suffered serious damage to his shoulder and kidneys after the incident.

A third underground worker, Dean Fox, 43, received only minor cuts and bruises.

It was claimed that the defendants and three unknown accomplices kicked and punched the customers before running back into their shop and pulling down the shutters.

But the jury of six men and six women took just two hours to clear them of violent disorder and two counts of grievous bodily harm at Snaresbrook Crown Court.

The three Turks all claimed they were acting in self-defence when their customers became abusive and attacked them at the Antonia Kebab House in Stratford Broadway.

The tube workers had visited the take-away late on April 2 last year.

All three then ordered and paid for kebabs, but only Mr Hayes and Mr Fox were given their food, the court was told.

When Mr Page asked for his meal an argument broke out between himself and the two men behind the counter, Koca and Ergun Aslan.

They were told the item had never been ordered or paid for.

The defendants claimed the men refused to leave
and began pushing the staff around.

But they managed to push the men out of their shop.

Shop owner Huseyin Aslan claimed he was simply trying to protect his property and immediately pulled down the shutters to keep the men out.

But he said the customers pulled the metal shutters back up and tried to break back into the kebab house.

Koca and Ergun Aslan told the court they went outside to fight the men off who were shouting racist abuse.

Ergun Aslan said he only hit back at one of the customers after he was given a bloody nose.

Huseyin Aslan was accused of breaking Mr Hayes’ jaw with a kick to the face but he denied joining in the fight.

Married father of one Koca also told the court that the customers were the aggressors.

Huseyin Aslan, of Bury Street, Edmonton, north London, Ergun Aslan, of Spencer Road, Tottenham, north London and Koca, of Hebrew Court, Hackney, north London, were all found not guilty of two charges of causing grievous bodily harm and one charge of violent disorder.
