A wouldbe solicitor studying for her exams was raped after
she confronted an intruder in her mansion block flat, the Old
Bailey heard today (Wed).
Miss X was alone in the Earls Court, sw London apartment when
she heard a noise in the hallway.
When she went to investigate she spotted a figure crouching
near an open window.
‘From a distance she thoguht he looked about 12-years-old and
thought nothing of approaching him,’ said prosecutor Mr Stephen
Smyth.
She demanded to know what he was doing tampering with the
window and the youngster replied that he was ‘playing hide and
seek with my friends.
‘
Miss X, still thinking the intruder was a young boy – in fact
he was 18-years-old Mushtaq Hussain, a many times convicted
burglar – ordered him to write down his name and address before
he left.
She returned to her apartment to get a pencil followed by the
youth.
He wrote out a bogus address and was then told to be on
his way.
Suddenly the babyfaced youth turned.
He refused to leave,
grabbed the young woman’s neck and forced her into a bedroom.
‘He pushed her onto the bed and sat on top of her,’ said Mr
Smtyh.
He told her to stop struggling and threatened: ‘I will
really hurt you and get my flick knife out.
‘
Hussain yanked at her jeans, but in tears she continued to
struggle.
He indecently touched her repeatedly saying: ‘Aren’t you
enjoying it.
‘
He then forced her to submit to a sexual indignity, said
counsel.
Sobbing she pleaded: ‘Why are you doing this? If it was your
sister or mother how would you feel?’
Throughout her ordeal Miss X tried various ruses and ploys to
stop Hussain.
After the assault in the bedroom Hussain suddenly became
‘nervous’ and realising that they could be overlooked tried to
drag his victim out of sight into the bathroom.
‘She clung to the door frame, but he pulled her inside and
very much the same thing happened in there.
‘After that he made her return to the bedroom.
‘
While she huddled sobbing and crouched in the corner of the
room he rummaged through it looking for valuables.
Hussain went through her handbag and stole a signet ring and
Dunhill lighter.
He went through the flat saying: ‘I must get 400 quid by the
end of the day,’ continued counsel.
His manner then suddenly changed and he asked permission to o73
drink a can of beer from the kitchen.
‘He then started to talk to her – chatting her up,’ said Mr
Smyth.
He wanted to know who else lived in the flat and when they
would be returning.
‘She tried to get rid of him by saying her sister would be
home by 3pm.
That didn’t have the desired effect because he said
he would wait and have her handbag too.
‘
Throughout Miss X was crying, the court was told.
Hussain then had the audacity to ‘invite her’ back into the
bedroom remarking: ‘You know you like it.
‘
Miss X continuing to try and put him off said: ‘You are
disgusting.
You are just so horrible.
‘
Hussain finally left after stealing over pnds stlng 2,000
worth of valuables.
He warned his victim to say nothing about
what happened or else he would return.
He was arrested on February 3, this year after police found
his fingerprints in the flat.
Hussain who lives with foster parents in Fulham, sw London
pleaded guilty at an earlier hearing to indecent assault and
burglary committed on May 23 last year.
Sentencing him to six years in a young offenders institution
Judge Brian Capstick QC said: ‘This was a cowardly and frighten
ing assault.
‘It was in fact oral rape by someone who sought to terrorise
his victim in her own premises and then went on to rob her –
steal her property.
‘You inflicted indignities on her and I am not surprised
that it has had a traumatic affect on her.
‘
It was earlier revealed that the victim, who is in her early
twenties, not only failed her exams, but has been left deeply
traumatised by the attack.
‘She doesn’t feel safe in her home.
She still gets fright
ened if she hears a noise outside despite additional security
that has been installed,’ revealed a detective.
Hussain, who has a large number of convictions mainly for
dwelling house burglaries, also admitted another offence of
burglary carried out in April 1990 and breach of two probation
orders imposed in 1990 and 1991 for two other burglaries.
He was sentenced to four-and-a-half-years for indecent
assault and 18 months consecutive for burglary, making six years
in all.
