Man with Tourette Syndrome doesn’t want to see any ‘f***ing psychiatrists
An accused flasher with Tourette Syndrome told a judge: I don’t want to f**king see them,’ when he was told he must be assessed by more psychiatrists.’
Robert Moaby, 51, is accused of masturbating at a woman outside Moorfields Eye Hospital on 15 July last year.
District Judge Clive Jenkin adjourned the case for doctors to assess after hearing he suffers from a series of mental issues
The convicted sex offender replied: ‘I’m not seeing them, I don’t want to f*cking see them.’
A Moorfields security guard spotted and photographed Moaby allegedly playing with his penis while facing a woman on City Road, Highbury Corner Magistrates heard.
Jim Skelsey, defending Moaby, said: ‘Mr Moaby has a complex range of disabilities, learning disabilities, intellectual disabilities, autism, and Tourette syndrome.
‘The failure, despite repeated exposure to the court, is unfit to plead. This is consistent with research on those with intellectual disabilities.
‘In my submission, he is not able to stand trial.
‘It is an allegation of outraging public decency, the alleged offence was very brief.
‘It is a security guard on the third floor of the hospital. She saw him fiddling with his trousers, and looking down at the area.
‘The evidence is not the strongest in this case.’
Prosecutor Louise Ahmad opposed the defence’s application because the report was written by a psychologist, not a psychiatrist.
Ms Ahmad said: ‘The Crown will not review or drop anything in connection with a sexual matter without a psychiatric report.’
The alleged flasher was convicted and sentenced to four and a half years in prison in August 2002 for sending terrifying death threats to bankers backing the controversial laboratories of Huntingdon Life Sciences.
Moaby, then 33, sent e-mails across the Atlantic warning that unless financiers pulled the plug on HLS they would be killed.
Moaby was a committed follower of hardline campaigners SHAC – Stop Huntingdon Animal Security.
The chilling wording of the messages and the inclusion of personal details of the victims meant the threats were taken seriously.
He was also charged with child porn offences when 2,800 images of children as young as four engaged in ‘appalling sexual acts’ were found on his computer.
Moaby was charged and admitted two counts of making threats to kill and making indecent images.
The animal lover was also required to register as a sex offender for life.
Moaby, of Central Street, Finsbury, is yet to enter a plea to one count of outraging public decency.
He was released on bail on condition of not visiting the City Road Pret A Manger.
He will appear again at Highbury Magistrates’ Court on 23 April.
