Cop says his DNA could have got on woman’s chest when he accidentally spat on her

A Met Police officer accused of assaulting a woman while responding to a domestic incident said she is ‘lying’ and that he is ‘disgusted’ by the allegations.

Spaniard PC Fabian Aguilar-Delgado claimed his DNA could have been transferred to her chest after she shook or ‘grabbed’ his hand – or when he talked loudly and accidentally spat on her.

The woman claims Aguilar-Delgado, 40, followed her upstairs and sexually assaulted at her home in Croydon, south London.

Most of the DNA found on a swab taken from the woman’s right nipple was linked to Aguilar-Delgado, Southwark Crown Court heard.

Prosecution and defence experts agree that saliva or sweat could have possibly been transferred if the woman touched her breast straight after the handshake when she came to thank him and his colleague.

Aguilar-Delgado told the court that he moved to the UK from Spain in 2013, and joined the police force in September 2019.

‘When I saw her sitting on the sofa I thought she was a confused woman,’ he said.

‘She was confused, kind of agitated.’

He said he sat next to her on the sofa.

‘I saw the sofa and I sat there to get her account better so that I could hear, to get her account down right.’

‘The way she was talking was a bit erratic, nervous I would say.’

‘Was she listening to you?’ asked Robert Morris, defending.

‘I would say not one hundred per cent’

Did you form an opinion of her at that point?’

‘I thought that she was under the influence of alcohol. I could smell alcohol on her breath.
She told us she was drinking a bottle of wine earlier that day.’

He told the court that at one point the woman ‘became rude’.

‘She was raising her voice. She said “f*ck off”‘.

‘Were you sexually attracted to her?’ the barrister asked

‘Of course not,’ he insisted.

Asked how he felt about the accusations against him he said:’Disgusted. She is lying.

He told the court that at one point, she came out to thank him and his colleague and shook their hands.

‘She came out to say thank you to everyone. She was trying to shake hands. She tried to put her hand into the police car and she grabbed my hand.

‘It wasn’t like a normal handshake. She just grabbed it.’

‘She really wanted to shake hands. She was looking for it.’

Asked how his DNA ended up on the woman he said ‘it could have been the handshake.’

He also said that when he was sitting next to her on the sofa he was talking loudly so that she could understand him, and that some of his spit could have ended up on her that way.

Asked how he felt when he found out that he had been accused of sexual assault he said: ‘I was shocked. I couldn’t sleep well.’

The woman admitted she had been sexually attracted to the officer and went out to give him her phone number on a brown paper envelope after the incident, but afterwards she felt he had used her.

Aguilar-Delgado, of Albany Road, Crawley, denies one count of sexual assault by touching.
