A spurned lover who viciously kicked his common law wife
after she ordered him to leave their home has been jailed for
12 months.
The 38-year-old jobless mechanic said he ‘just flipped’ when
she announced that their long relationship was over for good.
Earlier the pretty 37-year-old mother of his two children had
fled to a refuge to escape their occasionally ‘stormy and
violent’ relationship, the Old Bailey heard.
On April 5 this year, he broke a court injunction banning him
from visiting her New Addington home, in the hope of talking her
into taking him back.
But when she snubbed his attempts at peacemaking, he lashed
out violently, said Mr Jeremy Benson, prosecuting.
The man admitted assaulting her, causing actual bodily harm but
denied allegations that he raped her at knifepoint and
threatened to kill her.
Now living in Kennington Road, Kennington, he was cleared by
an Old Bailey jury of the rape and threat charges.
Judge Geoffrey Rivlin QC said the assault was a serious one.
‘You regained contact with her and your two children, who I
accept you are extremely fond of.
‘You very much hoped there was to be a reconcilitation but
when she told you it was impossible, you flipped.
‘You slapped her and pushed her hard and, I have no doubt,
kicked her.
‘
The defendant shook his head and said: ‘No, you’re wrong’ as
the kicking allegation was mentioned.
Judge Rivlin accepted that he was an emotional person with a
very short temper but said the crime deserved a jail term and
sentenced him to 12 months prison.
